1. Provider and contact details

The mobile game “ReZeT” (the “Game”) is developed and distributed by:

In this document, “Topbit01”, “we”, or “us” refers to the group of people who develop and operate the Game.

2. Scope of these Terms

These Terms and Conditions of Use (the “Terms”) govern:

  • your use of the ReZeT Game;

  • the creation and use of a game account;

  • any online services connected to it (such as cloud saves, leaderboards, updates).

By installing, accessing, or using the Game, you agree to be bound by these Terms.
If you do not agree to these Terms, you must not install, access, or use the Game.

For iOS users, these Terms apply in addition to Apple’s Licensed Application End User License Agreement (Standard EULA). In case of conflict, mandatory consumer protection rules and the more favorable provisions for the consumer will prevail.

3. Age requirements and use by minors

The Game is intended for a general audience and is suitable for minors, with cartoon-style violence only, no blood, no strong language, no sexual content or references.

  • If you are under the age required by the laws of your country to validly provide consent (for example, 13 or 16 in the EU, depending on the country), you may only use the Game with the consent and under the supervision of a parent or legal guardian.

  • By installing and allowing a minor to use the Game, the parent or legal guardian:

    • accepts these Terms on behalf of the minor; and

    • agrees to supervise the minor’s use of the Game.

Topbit01 cannot verify each user’s actual age; we reserve the right to request proof of age or parental/guardian consent when needed.

4. License to use the Game

Subject to mandatory consumer rights:

  • Topbit01 grants you a personal, limited, revocable, non-exclusive, non-transferable license to:

    • download, install, and use the Game only on devices you own or control;

    • use the Game solely for personal, non-commercial purposes.

You must not:

  • copy, modify, distribute, sell, rent, sublicense, translate, or create derivative works of the Game or any part of it, except where expressly allowed by applicable law;

  • reverse engineer, decompile, or otherwise attempt to extract the source code, except within the limits permitted by law;

  • bypass, disable, or interfere with security features, anti-cheat systems, or technical protection measures.

All rights not expressly granted remain with Topbit01.

5. Free nature of the Game and no monetary transactions

At the time these Terms are drafted:

  • the Game is available free of charge;

  • it does not include in-app purchases, subscriptions, purchasable virtual currencies, real-money prizes, or gambling mechanics;

  • it does not display third-party advertisements or paid promotional content.

Topbit01 may change the Game’s business model in the future (for example by introducing new free or paid features). In such case, these Terms may be updated and you may be asked to accept the updated conditions before using the relevant features.

6. Accounts, credentials, and security

To access certain features of the Game (such as online saves, leaderboards), you may be required to create an account by:

  • registering with an email address and password;

  • logging in via third-party providers (e.g. Google or Apple accounts), where available.

You agree to:

  • provide accurate and up-to-date information;

  • keep your login credentials confidential;

  • not share or transfer your account to third parties;

  • promptly notify Topbit01 if you suspect any security breach or unauthorized use of your account.

Topbit01 is not liable for losses or damages arising from unauthorized use of your account by third parties, except as required by applicable law.

7. User conduct and anti-cheating rules

By using the Game, you agree not to:

  1. Cheat or manipulate the Game

    • use bots, scripts, mods, trainers, third-party software, or any other means to alter gameplay, scores, leaderboards, or the operation of the Game;

    • exploit bugs, glitches, or vulnerabilities to gain unfair advantages.

  2. Illegal or abusive use

    • use the Game in violation of applicable laws;

    • interfere with the Game’s servers, databases, or technical infrastructure;

    • attempt to gain unauthorized access to other users’ accounts or data.

  3. Fraud or misuse of the services

    • use false or misleading identities;

    • create multiple accounts with the purpose of manipulating leaderboards, statistics, or progression systems.

Topbit01 reserves the right, acting reasonably, to apply technical and/or disciplinary measures (including suspension or termination of your account) against users who breach the rules above.

8. Third-party services

The Game may use or interface with third-party services, such as:

  • authentication services (e.g. Google, Apple, etc.);

  • backend / database services (e.g. hosting and database providers located within the European Union);

  • possible analytics, logging, or crash reporting services;

  • services offered by app store operators.

Your use of such services may be governed by their own terms and conditions and privacy policies, which are separate from these Terms. Topbit01 is not responsible for the content, availability, or operation of third-party services it does not control.

9. Personal data and privacy

While using the Game, Topbit01 may process personal data, including:

  • email address, nickname, user ID;

  • data provided by login providers (e.g. Google/Apple), within the scope of your granted permissions;

  • country and/or approximate region;

  • gameplay data (progress, statistics, settings, etc.);

  • technical and log data required for operating the Game, preventing fraud/cheating, and improving the service.

The servers used to store data are hosted within the European Union.

Data may be processed for:

  • providing the Game and its features;

  • managing accounts, saves, leaderboards, and security;

  • maintaining, optimizing, and improving the Game;

  • aggregate and anonymous analytics on how the Game is used.

Details about how we process personal data are provided in our Privacy Policy, made available within the Game and/or on Home – Topbit01 . In case of any inconsistency between these Terms and the Privacy Policy concerning personal data, the Privacy Policy shall prevail.

10. Availability of the Game, changes, and updates

The Game and its features are provided on an “as available” basis. Topbit01 may, at any time and without prior notice:

  • change the content, features, or balancing of the Game;

  • release updates, patches, bug fixes, or new versions;

  • temporarily suspend access for technical maintenance;

  • discontinue, permanently or temporarily, the Game or certain features (for technical, legal, or strategic reasons).

Where reasonably possible, Topbit01 will try to inform users through the Game, the website, or the app stores about material changes or extended interruptions.

11. Disclaimer of warranties

To the maximum extent permitted by applicable law:

  • the Game is provided “as is” and “as available”, without any warranties of any kind, express or implied;

  • Topbit01 does not warrant that:

    • the Game will be error-free or bug-free;

    • the Game will be compatible with all devices, OS versions, or hardware configurations;

    • the Game or servers will be continuously available, uninterrupted, or secure;

    • the Game will meet your specific expectations or requirements.

Nothing in these Terms excludes or limits any statutory warranties or rights that cannot be excluded under applicable consumer protection laws.

12. Limitation of liability

To the maximum extent permitted by applicable law:

  • Topbit01 shall not be liable for indirect, consequential, special, incidental, or punitive damages, including but not limited to:

    • loss of data or game progress;

    • loss of opportunities or profits;

    • business interruption;

    • damages resulting from misuse, unauthorized use, or non-compliant use of the Game.

In any case, Topbit01’s total liability to you for any claim arising out of or in connection with the Game shall be limited to the total amount, if any, paid by you to Topbit01 for your use of the Game during the twelve (12) months preceding the event giving rise to the liability (which, as of now, is zero, since the Game is free).

This clause applies to the extent permitted by law and does not exclude or limit liability that cannot be excluded or limited under applicable law (for example, in cases of wilful misconduct, gross negligence, or personal injury caused by defective products where such liability is mandatory).

13. Suspension and termination of the account

Topbit01 may suspend or terminate your account and/or restrict access to the Game, in whole or in part, if:

  • you materially or repeatedly breach these Terms;

  • you engage in cheating, hacking, or manipulating the Game;

  • your account is used for illegal or abusive purposes;

  • we are required to do so by law or by a competent authority.

Where reasonably possible, we will inform you about the suspension/termination and the main reasons for it, unless prohibited by law or for security reasons.

You may uninstall the Game at any time and, where available, request deletion of your account as described in the Privacy Policy.

14. Governing law and jurisdiction

Without prejudice to any mandatory consumer rights that cannot be waived:

  • these Terms are governed by Italian law;

  • any dispute arising out of or relating to the validity, interpretation, or performance of these Terms shall be submitted to the competent court of the consumer’s place of residence or domicile within the European Union, or, for users who are not considered consumers, to the competent court where Topbit01 is established.

In all cases, nothing in these Terms limits any rights you may have under the consumer protection laws applicable in your country of residence.

15. Changes to these Terms

Topbit01 may update these Terms from time to time (for example to:

  • introduce new features;

  • comply with changes in laws or app store policies;

  • improve clarity and structure).

Changes become effective when published in the Game, on the website, or in the app stores, or on another date that may be specified.
In case of material changes, we may ask you to accept the updated Terms; if you do not accept them, you may not be able to continue using the Game.
